What action should I take when my landlord tries to conceal information?
A fire that started on the first floor of my apartment building two months ago caused damage to my second floor unit that has still not been repaired. One week after the fire I called my landlord for information about the fire, but she claimed she didn't know the cause. Yesterday I found out that the fire was caused by the first floor neighbors cigarette and that she was fully aware of this. She could have assumed, because they were smokers, but knew for certain? You can't prove that unless she talked to others and you can get them to testify to it. And anyways why would you bother? What does it matter? All you need to care about is getting your unit repaired. Your landlord is required to fix structural damages such as those caused by the fire. If you've had to deal with this for two months and its still not fixed then you should talk to her supervisor if she has one. If not, talk to her some more about getting it fixed. Landlords have insurance to cover these sort of damages, and are required by law to give you a liveable clean space to live. If she doesn't fix it you can take her to court to fix it, and win. If the units occupants downstairs were negligantly responsible for the damages her insurance would still cover all damages and then sue the occupants. So you still wouldn't have to deal with it. If you are worried about ruining any good standing with the landlord over this, instead of taking her to court, try informing the local housing police about the problem. They will look into it and decide how to proceed from there. If the space is in need of repair they will fine her day by day till the work is done, which will light a fire under her to fix it now (lol)
